How is the gift deduction determined?
It depends on your relationship to the giver, aggregated over a rolling 10-year window. Spouse: ₩600 million. Ancestor (parent, grandparent, etc.): ₩50 million (₩20 million if the recipient is a minor). Descendant (child, grandchild, etc.): ₩50 million. Other relatives within the 4th degree of blood or 3rd degree by marriage: ₩10 million (Inheritance Tax and Gift Tax Act Art. 53). This limit isn't a one-time allowance — it's tracked and shared across all gifts from that person over 10 years.
What is the marriage/childbirth gift deduction?
If you receive a gift from an ancestor within 2 years before/after your marriage registration, or within 2 years of a child's birth, you can deduct up to an extra ₩100 million on top of the basic gift deduction (₩50 million) — introduced in 2024 (Inheritance Tax and Gift Tax Act Art. 53-2). The combined cap for both the marriage and childbirth deductions together is ₩100 million.
Why does 10-year aggregation matter?
It exists to prevent splitting a large gift into smaller pieces to dodge the progressive rate structure. If gifts from the same person (or their spouse, when that person is your ancestor) total ₩10 million or more within 10 years, the prior gift value is added to this gift's taxable base before applying the progressive rate. Tax already paid on the prior gift is then subtracted as a prior tax credit to avoid double taxation (Inheritance Tax and Gift Tax Act Art. 47(2), Art. 58).
Why is tax higher for a generation-skipping gift?
When a grandparent gives directly to a grandchild, skipping the parent's generation, that gift effectively avoids the round of gift (or inheritance) tax that generation would otherwise have paid — so a 30% surcharge applies to the calculated tax. If the recipient is a minor and the gift exceeds ₩2 billion, the surcharge rises to 40%. An exception applies when the giver's child died first and the grandchild inherits their place (substitute inheritance) — that case is exempt from the surcharge (Inheritance Tax and Gift Tax Act Art. 57).
When does the filing tax credit apply?
Filing your gift tax return within 3 months of the end of the month the gift occurred earns a 3% credit on the calculated tax (after the prior tax credit) (Inheritance Tax and Gift Tax Act Art. 69(2)). Missing the deadline forfeits this credit and triggers separate late-filing/underreporting penalties, which this calculator does not compute.
How do I enter the value of a gifted property or stock?
In principle, use the fair market value as of the gift date (comparable sale price, appraised value, etc.). When fair market value is hard to determine, supplementary valuation methods apply (officially assessed value, etc.). This calculator does not perform that appraisal — confirm the value via Hometax or a tax accountant and enter it directly.
